1. Agreement to Terms
These Terms of Service ("Terms") govern your use of the Lwandle Finance Solutions (Pty) Ltd ("we", "our", "us", "Lwandle Finance") website, mobile application, and related services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

2. Eligibility & Account Requirements
2.1 Age and Legal Capacity
- You must be at least 18 years old to use our services
- You must be a South African citizen or permanent resident
- You must have the legal capacity to enter into binding agreements
- You must not be under debt review or sequestration
2.2 Account Registration
- You must provide accurate, complete, and current information
- You are responsible for maintaining the confidentiality of your account
- You must notify us immediately of any unauthorized use
- You may only create one account per person
2.3 Required Documentation
- Valid South African ID document or passport
- Proof of income (salary slips, bank statements)
- Proof of residence (utility bill, lease agreement)
- Banking details and account verification
3. Loan Services & Products
3.1 Available Products
- Payday loans: R1,000 to R5,000 (30-day terms)
3.2 Loan Amounts & Limits
- Minimum loan amount: R1,000
- Maximum loan amount: R5,000 (subject to affordability)
3.3 Interest Rates & Fees
Important: All interest rates and fees comply with National Credit Act (NCA) regulations.
- Interest rates: 5% - 27.5% per annum (depending on loan term and risk assessment)
- Initiation fee: Maximum R1,140 or 15.5% of loan amount (whichever is lower)
- Monthly service fee: Maximum R69 per month
- All fees are disclosed before loan agreement signature
4. Application Process & Credit Assessment
4.1 Application Submission
- Applications can be submitted online or via WhatsApp
- All required documentation must be provided
- Applications are processed within 24-48 hours
- Incomplete applications may be rejected or delayed
4.2 Affordability Assessment (NCA Section 81)
- We conduct thorough affordability assessments as required by law
- Income verification and expense analysis
- Credit bureau checks and credit history review
- Debt-to-income ratio calculations
4.3 Approval & Disbursement
- Loan approval is at our sole discretion
- Approved funds are disbursed directly to your bank account
- Disbursement typically occurs within 24 hours of approval
- You will receive SMS and email confirmation
5. Repayment Terms & Obligations
5.1 Payment Schedule
- Repayments are due on agreed monthly dates
- Payment methods: Debit order, bank transfer, or cash deposit
- Payments are processed automatically via debit order (preferred method)
- Manual payments must be made before 16:00 on due date
5.2 Early Settlement
- You may settle your loan early at any time
- Interest rebates apply for early settlement (NCA Section 125)
- Contact us for early settlement quotations
- No penalties for early repayment
5.3 Late Payments & Default
Important: Late payments may affect your credit score and future loan eligibility.
- Grace period: 10 calendar days after due date
- Late payment fees may apply (maximum R100 per month)
- Default notices issued after 20 days overdue
- Credit bureau reporting for accounts 30+ days overdue
- Legal action may be taken for persistent default
6. Your Rights & Responsibilities

- Right to receive pre-agreement statement and quotation
- Right to apply for debt review if over-indebted
- Right to early settlement with interest rebate
- Right to receive annual statements of account
- Right to lodge complaints with NCR and Ombudsman
6.2 Your Responsibilities
- Provide truthful and accurate information
- Notify us of changes to contact details or financial circumstances
- Make payments on time and in full
- Use loan funds for stated purposes only
- Comply with all terms of the credit agreement

- You consent to receive automated messages

- You may opt-out by sending "STOP" at any time

9. Prohibited Uses & Restrictions
9.1 Prohibited Activities
- Providing false or misleading information
- Using loan funds for illegal activities
- Attempting to circumvent our security measures
- Creating multiple accounts to exceed lending limits
- Using automated systems to access our services
9.2 Account Suspension & Termination
- We may suspend or terminate accounts for policy violations
- Outstanding loan balances remain due after termination
- You may close your account at any time (subject to outstanding obligations)
10. Liability & Disclaimers
10.1 Service Availability
- We strive for 99.9% uptime but cannot guarantee uninterrupted service
- Scheduled maintenance may cause temporary service interruptions
- We are not liable for delays caused by third-party service providers
10.2 Limitation of Liability
Our liability is limited to the maximum extent permitted by South African law. We are not liable for indirect, incidental, or consequential damages arising from your use of our services.

Continued use of our services after changes take effect constitutes acceptance of the updated Terms.

- Consumer Protection Act, 2008 (Act No. 68 of 2008)
- Protection of Personal Information Act, 2013 (Act No. 4 of 2013)
- Financial Intelligence Centre Act, 2001 (Act No. 38 of 2001)
Any disputes will be subject to the jurisdiction of South African courts.
